Writing a will. It’s one of those tasks in life that people put off. Why? It seems somewhat morbid to be thinking about death and putting plans into reality for a time when you’re not here. It’s not nice and its one of the more grown-up tasks that people never really get around to doing.

The statistics prove this. According to the Law Society, around 50% of people don’t have a will. It’s one of those admin jobs that never make it to the top of the to-do list.

Still not convinced it’s more urgent than you think it is? Here’s what happens when you die without a will in place.

Your Estate Doesn’t Go To Who You Think It Will

Most people assume that everything passes neatly onto their partner or kids. It’s not true. Without a will, the law decides who gets what, and this could mean that your loved ones are passed over due to intestacy rules, where assets get split in fixed ways. And it’s not always fair.

If you are unmarried, your partner may end up with nothing. If you have kids from a previous relationship that might inherit before your current spouse, and if you run a business, things can get really messy.

Business Ownership Gets Stuck in Limbo

This is brutal to think about, but if you die and there’s no will in place, there’s no authority and everything stops. The business can’t trade, money can’t be accessed, wages don’t get paid and everything starts to unravel.

A will fixes all of this. It prevents the business from stopping—it’s not just a legal piece of paperwork; it’s a continuity plan in disguise.

This is where local will writing solicitors earn their keep. They get local quirks, regulations, laws and exactly what needs to happen to business and personal assets in the event of your death. They can work with you to ensure nothing is overlooked and things go on exactly how they need them, even if you’re not involved.

The Taxman Takes A Bigger Slice

The last thing anyone wants is for the taxman to benefit unnecessarily from your death. No will means no tax planning, and this means the government gets more than anyone else. The UK inheritance tax kicks in at £325,000, and anything above that can be hit with 40%. For most homeowners, that threshold isn’t hard to reach.

A solicitor can structure things better—using allowances, joint ownership, or business reliefs—so what you’ve built actually stays with the people it’s meant for. It’s not avoidance; it’s smart planning.

You Lose Your Choice

Most importantly, not having a will means you lose the right to have your choices adhered to. It’s not just about assets; it’s about you and your voice. It’s about giving to those you trust what you want, not strangers. It’s finances, guardianship, property, etc., going to the right people in your life.

It doesn’t need to be formal or complicated; it just needs to be written down, witnessed and kept safe.
